Kdo je vlastn\u00edk plotu mezi dv\u011bma pozemky? Kdo ho m\u00e1 udr\u017eovat? Dne\u0161n\u00ed pr\u00e1vn\u00ed \u00faprava vych\u00e1z\u00ed z toho, \u017ee plot pat\u0159\u00ed tomu, na jeho\u017e pozemku skute\u010dn\u011b stoj\u00ed. Plat\u00ed p\u0159itom jednoduch\u00e9 pravidlo: o plot pe\u010duje jeho vlastn\u00edk. Pokud jste vlastn\u00edkem plotu, m\u00e1te povinnost jej udr\u017eovat v odpov\u00eddaj\u00edc\u00edm technick\u00e9m stavu. \u201e<span class=\"c6\">Povinnost \u00fadr\u017eby ale neznamen\u00e1, \u017ee by vlastn\u00edk musel plot nebo ze\u010f v p\u0159\u00edpad\u011b jejich ch\u00e1tr\u00e1n\u00ed automaticky znovu postavit<\/span><span class=\"c1\">,\u201c dod\u00e1v\u00e1.<\/span><\/p>\n<p class=\"c5\" style=\"text-align: justify;\"><span class=\"c1\">V p\u0159\u00edpadech, kdy je plot spole\u010dnou rozhradou na hranici pozemk\u016f, nesou odpov\u011bdnost za jeho stav oba soused\u00e9 spole\u010dn\u011b. Na \u00fadr\u017eb\u011b nebo oprav\u00e1ch se pak zpravidla pod\u00edlej\u00ed oba.<\/span><\/p>\n<p class=\"c5\" style=\"text-align: justify;\"><strong><span class=\"c7\">Domluva je z\u00e1klad<\/span><\/strong><\/p>\n<p class=\"c5\" style=\"text-align: justify;\">Stejn\u011b jako u jin\u00fdch sousedsk\u00fdch vztah\u016f plat\u00ed i u oplocen\u00ed, \u017ee nejv\u011bt\u0161\u00edm zdrojem probl\u00e9m\u016f b\u00fdv\u00e1 nedostate\u010dn\u00e1 domluva mezi sousedy. Pr\u00e1v\u011b ta je pro p\u0159edch\u00e1zen\u00ed budouc\u00edm spor\u016fm kl\u00ed\u010dov\u00e1. Je\u0161t\u011b p\u0159ed samotnou realizac\u00ed se proto vyplat\u00ed m\u00edt jasno v tom, kudy p\u0159esn\u011b hranice pozemk\u016f vede. \u201e<span class=\"c6\">V praxi je rozumn\u00fdm krokem p\u0159izvat geodeta, kter\u00fd hranici odborn\u011b vyty\u010d\u00ed<\/span><span class=\"c1\">,\u201c upozor\u0148uje pr\u00e1vn\u00edk. Za drobnou stavbu se pova\u017euje oplocen\u00ed do v\u00fd\u0161ky 2 metr\u016f mezi pozemky, kter\u00e9 se nach\u00e1zej\u00ed v zastav\u011bn\u00e9m \u00fazem\u00ed nebo v zastaviteln\u00e9 plo\u0161e.<\/span><\/p>\n<p class=\"c2\" style=\"text-align: justify;\"><span class=\"c6\">\u201eV\u00fd\u0161ka 2 metry p\u0159edstavuje z\u00e1konnou hranici. Jakmile ji plot p\u0159es\u00e1hne, u\u017e se nejedn\u00e1 o drobnou stavbu a z\u00e1m\u011br je nutn\u00e9 povolit v r\u00e1mci stavebn\u00edho \u0159\u00edzen\u00ed. Novinkou pr\u00e1vn\u00ed \u00fapravy je, \u017ee u\u017e nen\u00ed rozhoduj\u00edc\u00ed, zda oplocen\u00ed nebo op\u011brn\u00e1 ze\u010f soused\u00ed s ve\u0159ejn\u00fdm prostranstv\u00edm.
